Following an article in the AD and in various other media, the discussion about smoke-free terraces has been rekindled. KHN advocates a hospitable catering industry. Smokers are also welcome on the terrace. It is one of the few places where guests can smoke.
What about now?
Can your guests continue to smoke on the terrace? What about exactly? KHN lists the facts for you: Smoking is now prohibited in the entire catering industry. However, private spaces, smoking areas and the open air (including terraces) are exempt from the smoking ban. These exceptions are regulated in the Smoking Ban Decree, which is part of the Tobacco Act. Your guest is therefore allowed to smoke on the terrace. You are of course free to create a smoke-free zone on your terrace.
Covered terrace
Smoking on an outside terrace is also possible under an awning or umbrella-shaped construction, as long as the terrace is fully open on at least 1 side (top or side). The terrace may not cause smoke nuisance inside your catering facility. A permanent extension, such as a conservatory, cannot be classified as a terrace.
